Terms and conditions

This catalogue is intended solely for members of the Nursery Trade. We also produce a retail list, and a price list for Woodland and Farm Planting.

Plant material is grown in our Nurseries at Ashford and is offered subject to crop and to stocks remaining unsold on receipt of a firm order. We welcome visitors to our Nurseries to inspect our stocks by appointment.

Prices and Delivery

All prices shown are in Sterling. Prices in this catalogue are ex-nursery and subject to VAT at the appropriate rate. Orders over £3000, in our main delivery area are delivered free. For orders under this value there will be a charge of 10% for delivery in England, and 12% for Scotland and Wales. There is a minimum delivery charge of £60. Alternatively we can despatch anywhere in the UK by public carrier at cost. For each pallet used there will be a charge of £10. There is a minimum order value of £500 and the smallest number of bundled plants is 25 of a species.

References

First transactions are conducted on a pro-forma invoice basis. Thereafter, customers are requested to send the normal trade and bank references.

Cancellations

Should any unfulfilled orders be cancelled by the purchaser we reserve the right to charge 50% of the value of the order as liquidated damage without having to prove our action.

Settlement

Payment is due not later than 30 days from the invoice date. Interest at 1.5% per month will be charged on all overdue accounts. Goods remain the property of Oakover Nurseries Limited until the full price has been paid. We are happy to accept payment by credit/debit card.  Please contact to discuss.

Complaints

All complaints to be made in writing within 7 days.

Reservation of Title

The risk in the goods passes to the buyer upon delivery but equitable and beneficial ownership shall remain with us until full payment has been received (each order being considered as a whole) or until prior re-sale, in which case our beneficial entitlement shall attach to the proceeds of resale or to the claim or such proceeds. We reserve the right to re-posses any goods in respect of which payment is overdue and the purchaser hereby permits us access to the premises at which the goods are located for this purpose.

Warranty

Whilst every care is used to supply stocks of highest quality true to name, no warranty expressed or implied is given as to description, productiveness or any other matter, and we cannot be responsible for failures. All orders are executed on these conditions only.

Liability

While every effort is made to execute orders to our customer’s satisfaction, no guarantee of completion by a fixed date can be given and no claim for any consequential losses will be accepted. In all cases our liability is limited to replacing the items at fault, or making an allowance not exceeding the amount charged for the goods in question.

Force Majeure

We will not be liable for any claim relating to our failure to supply, where this failure has arisen due to climate, natural, accidental or any other causes beyond our control.

Acceptance of Terms

The placing of an order implies the acceptance of the terms which shall be governed by English Law.
